The Music Zoo Official Contest Rules

TERMS AND CONDITIONS

INTRODUCTION

  1. This Contest will be governed by these standard terms and conditions ("Terms"). Each Entrant agrees that he/she has read and understands these Terms and, by their participation in the Contest, each Entrant agrees to be bound by the Terms.

  1. The Organizer of the Contest is The Music Zoo (The Music Zoo, 55 Lumber Road, Roslyn, New York 11576) ("Organizer"), which shall be solely responsible for the execution and administration of this Contest.

  1. Entrants may enter the Contest by accessing the website through www.themusiczoo.com (the "Contest Site"). There is no fee to enter the Contest, however internet access charges or other third party connectivity charges may apply. Please check with your internet service provider for current internet access charges, if any. In entering this Contest, all Entrants are deemed to have the permission of the person paying such third party charges.

  1. Each Entrant will be eligible to win one Taylor 418e Acoustic Guitar (collectively the "Prize").

ENTRY PERIOD

  1. The Contest shall run strictly in accordance with the stipulated timeframe as stated herein.

  1. The Contest will commence for a period of thirty (35) days from 21 May 2015 until 25 June 2015 (the "Contest Period"). Organizer reserves the right to extend the Contest Period.

ELIGIBILITY

  1. This Contest is open to all residents of the fifty (50) United States, the District of Columbia and Puerto Rico.

  1. To enter the Contest, Entrant must be a minimum of eighteen (18) years of age or older at the time of entry.

  1. No purchase is necessary to enter to win or participate in the Contest. Entrants consent to be opted-in to The Music Zoo and Taylor mailing lists, but have the option to opt-out at of futures emails at any time.

  1. The following categories of persons are not eligible to enter the Contest: employees (including their immediate family members) of Organizer or its respective divisions, authorized dealers/distributors, agents; suppliers of the Prize; and any other company professionally connected with this Contest. "Immediate family" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

ENTRY RESTRICTIONS

  1. This Contest shall be void where prohibited or restricted by law.

  1. All personal details submitted must be accurate and complete and are subject to proof upon request by the Organizer. The Organizer reserves the right, at any time, to verify the validity of entries and Entrants, and to disqualify any entry not submitted in accordance with these Terms or which interferes with the entry process.

  1. Incomplete, indecipherable, illegible or incorrect entries or any entry which violates the Terms, will automatically be disqualified. Entries received after the Closing Date will be disqualified.

  1. The Organizer will not accept any responsibility for entries lost, delayed, misdirected, damaged or undelivered. The Organizer shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to the Contest.

  1. Entrants may not submit more than one (1) entry. In the event of repeat submissions, the Entrant will be disqualified from the Contest. In the event it is discovered that an Entrant has attempted to obtain more than one entry by using multiple or different identities, email addresses and/or any other methods will void that Entrant's entry and that Entrant will be disqualified from the Contest. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account (provided via the Entry Form) is registered. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address.

  1. Only entries from individuals will be accepted. Any entry that Organizer believes has been made (a) via participation in a syndicate or (b) via any form of machine-assisted intervention enabling computer generated multiple entries, will be disqualified. Organizer reserves the right to discount multiple entries from the same IP address.

  1. By entering, each Entrant: (i) represents that he/she is at least eighteen (18) years of age and otherwise eligible to participate in the Contest; and (ii) fully and unconditionally agrees to accept these Terms and the decisions of Organizer, which are final and legally binding in all respects.

    WINNING/NOTIFICATION

    1. The Organizer's representatives or appointed judges will select a Winner from amongst all eligible entries (The "Winner") by random selection (for lucky draws or games of chance). The Organizer's decision is final and no correspondence will be entertained. The Winner will be notified via email or telephone (as provided by the Entrant in his/her submission), confirming their Prize and providing details on how to acknowledge and collect the Prize. In the event that the Organizer cannot for any reason obtain the Winner's acknowledgement within twenty four (24) hours of first attempting to do so, the Organizer reserves the right to select an alternative Winner at its sole discretion.

    1. The Organizer reserves the right to select an alternative Winner at any time, where the Organizer has reasonable grounds for believing that the initially selected Winner has contravened any of these Terms. Any alternative Winner will be selected applying the same criteria as that used to select the original Winner.

    1. The Organizer reserves the right to deal with any unclaimed Prize in any manner it deems fit.

    TRAVEL TERMS

    1. Organizer is not responsible for any travel and transportation or other related expenses incurred by Winner in connection with the Prize. All such expenses should be the sole responsibility of the Winner.

    PRIZE

    1. The Prize is as stated and is non-transferable and not-for-sale. No cash alternatives will be offered. If due to circumstances beyond the Organizer's control, the Organizer is unable to provide the stated Prize or any part thereof, the Organizer reserves the right to substitute the Prize with an item of equal or greater value, to be determined at the Organizers' sole discretion. The Prize shall be subject to the additional terms and conditions of any supplier of the Prize other than the Organizer. Nothing herein shall be construed to supersede or negate any such term. More details on the collection of the Prize will be given to the respective Winner at a later time.

    1. Acceptance of the Prize shall constitute consent on the Winner's part (including Winner's companion's part, as the case may be), to allow the use of the Winner's (and Winner's companion's) entry, names, images, video footage, voices and/or likeness by the Organizer for editorial, advertising, promotional, marketing and/or other purposes, without further compensation, in any media for an unlimited period of time, except where prohibited by law.

    RELEASE

    1. Acceptance of the Prize shall constitute a release and discharge of the Organizer and without limitation its employees, agents and representatives (collectively, the "Released Parties") by Winner (and/or their companions) from any and all liability, claims, demands, causes of action, and/or damages whether known or unknown of any nature arising out of or related to the Contest and the Prize including but not limited to any property damage, theft or loss suffered by an Entrant (and/or their companions) as a result of the use and/or enjoyment of the Prize, and/or any tax liabilities in relation to the Contest, Prize and/or use or enjoyment of the same.

    1. By Entering the Contest, Entrants release, discharge and hold harmless from all liability the Organizer and without limitation its employees, agents and representatives from (i) any delay in performing or partial or total failure to perform any of their obligations to the Winner under these Terms if such delay or failure is caused by circumstances beyond the reasonable control of the Organizer, its respective divisions, affiliates, authorized dealers/distributors, agents, suppliers of the Prize, including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or (ii) any loss, damage to property, injury, or death resulting from or related to, but not limited to, entrant's participation or inability to participate in this Contest, preparation for, travel to, or travel during the Contest, or the use, misuse or inability to use the Prize or any portion thereof or participation in any Contest-related activity, including, but not limited to, any claims based on publicity rights, defamation, invasion of privacy and merchandise delivery.

    1. Each provision excluding or limiting liability is to be construed separately and will apply and survive even if for any reason any of the other provisions are held to be inapplicable or unenforceable in any circumstances. Each of the provisions excluding or limiting liability will remain in force notwithstanding any termination of these Terms.

    1. Any personal information, including without limitation, the Entrant's name, age, address (including postcode), telephone number and/or email address will be used solely in connection with this Contest and for any purpose for which the Entrant specifically opts in and will not be disclosed to any third party except for (a) the purpose of fulfilling the Prize where applicable and (b) for any purpose for which the Entrant specifically opts in. Any personal information held by the Organizer in respect of the Contest will be held on record for a reasonable period to fulfill the purpose for which such personal information was collected. If an Entrant gives the Organizer permission to pass on his/her personal information to a third party via a specific express consent/opt-in mechanism, then the privacy policy of such third party handling the personal information shall apply and the handling of the Entrant's information by such third party shall no longer be the responsibility of the Organizer. Entrants have a right to access, correct and have their personal data deleted from the Organizer's database. Entrants can exercise this right by sending a written request to The Music Zoo, 55 Lumber Road, Roslyn, New York 11576.

    1. No waiver of any rights by the Organizer or any Entrant will be taken as a waiver of any other rights they may have. For example, if the Organizer waives their right to object to a particular breach of these terms and conditions by one Entrant, it does not prevent the Organizer from objecting to any other breaches by that Entrant or any other Entrant.

    1. These Terms shall be governed by and construed in accordance with the laws of the State of New York.

    1. These Terms prevail over any provisions or representations contained in any other promotional materials advertised by Organizer.

    1. The Organizer reserves the right to terminate the Contest or to modify the Contest rules and Terms at any time in its sole and absolute discretion. Any such modifications shall be notified via the Contest Website, and such modifications shall be immediately effective and apply to all entries, including entries that have been submitted to the Organizer.

    SEVERABILITY

    1. Every provision of these Terms is severable. In the event one or more provisions of these Terms, or any portion thereof, are determined to be illegal or unenforceable, then the remainder of the Terms will not be affected thereby. The Terms shall be construed in all respects to the fullest extent permitted by law, and as if any invalid or unenforceable paragraph or provision was omitted.
